Gates Law is committed to protecting our clients’ privacy. We abide by the standards governing the legal profession, which require us to respect and protect our clients’ privacy and the confidentiality surrounding the legal services we provide to clients.
- What is ‘Personal Information’?
Personal Information is information about an identifiable individual, but does not include such publicly available information as an individual’s name, title, business address or telephone number. Retaining Gates Law to provide legal services to you is confidential and without your consent, we will not disclose that fact to any third party, other than as is reasonably necessary to provide you with legal services.
- Why do we collect Personal Information?
We collect personal information to assist clients by assessing their ongoing legal needs, delivering legal services, sending information to our clients and for business administration purposes.
- How do we collect your Personal Information?
We collect personal information directly from you or in some cases, from your agent, from third parties including your employer, insurance provider or financial institution.
- Use of your Personal Information
Gates Law complies with the duties of confidentiality and disclosure which are owed to clients, to the Court and to the legal profession.
- 10 Basic Principles
We collect, use and disclose personal information in accordance with 10 basic principles set out in The Personal Information Protection and Electronic Documents Act (“PIPEDA”):

- Consent
We will obtain your consent to our collection, use or disclosure of personal information, except where the law provides an exemption. Consent may be express, or it may be implied by the circumstances in which we gather the information, or in which the information is used. By using our legal services, you consent to the storage of your personal information in Canada, the United States or elsewhere as required by the service providers we use.
- Disclosure
There are certain circumstances prescribed under the law, where personal information may be disclosed without obtaining your consent, subject always to our duty of confidentiality owed to each of our clients. In such circumstances, we will not disclose any more information than is necessary.
- Accessing your Personal Information
You may ask to access your personal information by requesting such from the lawyer who is handling your file or from our firm’s Privacy Officer. If we refuse your request for access, we will inform you of this in writing and explain our reasons. We may require payment of a fee to cover reasonable administration costs associated with preparing a response or providing access to the personal information.
We will maintain the accuracy of your personal information, with your assistance. If your personal information needs to be changed, please let us know.
- Retention
We will retain your personal information for as long as necessary to fulfill the purposes for which it was collected. We will comply with retention standards applicable to the legal profession. We have destruction policies to destroy personal information that is no longer required to fulfill the intended purposes, after applicable retention periods have expired.
- Protecting your Personal Information
We will take reasonable precautions and implement reasonable technological measures to protect your personal information from access or disclosure by unauthorized third parties.
